کشورهای طرف این کنوانسیون به دلیل تمایل به حل و فصل همه مسائل مربوط به حقوق دریاها و آگاهی از اهمیت تاریخی این کنوانسیون، با روحیه تفاهم و همکاری متقابل، به عنوان کمکی مهم در حفظ و نگهداری، ترغیب می شوند. صلح، عدالت و پیشرفت برای همه مردم جهان؛ با اشاره به اینکه تحولات پس از کنفرانس های سازمان ملل متحد در مورد حقوق دریاها که در سال 1958 و 1960 در ژنو برگزار شد، نیاز به یک کنوانسیون جدید و عموماً قابل قبول در مورد حقوق دریاها را برجسته کرده است. و با آگاهي از اينكه مشكلات فضاي اقيانوسها ارتباط تنگاتنگي با هم دارند و بايد به طور كلي مورد توجه قرار گيرند. كشورهاي طرف اين كنوانسيون مطلوبيت ايجاد يك نظم حقوقي از طريق اين كنوانسيون را با توجه به حاكميت همه كشورها به رسميت مي شناسند. برای دریاها و اقیانوس ها که ارتباطات بین المللی را تسهیل می کند و استفاده صلح آمیز از دریاها و اقیانوس ها، استفاده عادلانه و کارآمد از منابع آنها، حفظ منابع زندگی آنها، و مطالعه، حفاظت و حفظ محیط زیست دریایی را ترویج می کند. و با توجه به اینکه دستیابی به این اهداف به تحقق نظم اقتصادی بین المللی عادلانه و عادلانه کمک خواهد کرد که منافع و نیازهای کل بشریت و به ویژه منافع و نیازهای ویژه کشورهای در حال توسعه را در نظر بگیرد، چه ساحلی و چه محصور در خشکی. کشورهای طرف این کنوانسیون در این کنوانسیون مایلند اصول مندرج در قطعنامه 2749 (XXV) 17 دسامبر 1970 را که در آن مجمع عمومی سازمان ملل متحد بطور رسمی از جمله مساحت بستر دریا و کف اقیانوس و زیرزمین آن، فراتر از محدوده صلاحیت ملی، و همچنین منابع آن، میراث مشترک بشر است که اکتشاف و بهره برداری از آن صرف نظر از موقعیت جغرافیایی کشورها، به نفع کل بشریت انجام خواهد شد. کشورهای طرف این کنوانسیون بر این باورند که تدوین و توسعه تدریجی حقوق دریاها به دست آمده در این کنوانسیون به تقویت صلح، امنیت، همکاری و روابط دوستانه بین همه ملتها با رعایت اصول عدالت کمک خواهد کرد. و حقوق برابر و ارتقاء اقتصادی و اجتماعی همه مردم جهان را بر اساس اهداف و اصول سازمان ملل متحد که در منشور ذکر شده است و تأکید می کند که اموری که توسط این کنوانسیون تنظیم نشده است همچنان توسط قواعد و اصول حقوق بین الملل عمومی.
The States Parties to this Convention are prompted by the desire to settle, in a spirit of mutual understanding and co-operation, all issues relating to the law of the sea and aware of the historic significance of this Convention as an important contribution to the maintenance of peace, justice and progress for all peoples of the world; noting that developments since the United Nations Conferences on the Law of the Sea held at Geneva in 1958 and 1960 have accentuated the need for a new and generally acceptable Convention on the law of the sea; and, conscious that the problems of ocean space are closely interrelated and need to be considered as a whole.The States Parties to this Convention are recognising the desirability of establishing through this Convention, with due regard for the sovereignty of all States, a legal order for the seas and oceans which will facilitate international communication, and will promote the peaceful uses of the seas and oceans, the equitable and efficient utilisation of their resources, the conservation of their living resources, and the study, protection and preservation of the marine environment and bearing in mind that the achievement of these goals will contribute to the realisation of a just and equitable international economic order which takes into account the interests and needs of mankind as a whole and, in particular, the special interests and needs of developing countries, whether coastal or land-locked. The States Parties to this Convention are desiring by this Convention to develop the principles embodied in resolution 2749 (XXV) of 17 December 1970 in which the General Assembly of the United Nations solemnly declared inter alia that the area of the seabed and ocean floor and the subsoil thereof, beyond the limits of national jurisdiction, as well as its resources, are the common heritage of mankind, the exploration and exploitation of which shall be carried out for the benefit of mankind as a whole, irrespective of the geographical location of States,The States Parties to this Convention are believing that the codification and progressive development of the law of the sea achieved in this convention will contribute to the strengthening of peace, security, co-operation and friendly relations among all nations in conformity with the principles of justice and equal rights and will promote the economic and social advancement of all peoples of the world, in accordance with the Purposes and Principles of the United Nations as set forth in the Charter, affirming that matters not regulated by this Convention continue to be governed by the rules and principles of general international law.
